Window Depot USA cuts ties with Mobile operation amid police investigation, nearly $500K in customer losses – fox10tv.com


MOBILE, Ala. (WALA) – Window Depot USA’s corporate office says the Mobile location is no longer authorized to use its name, trademarks, or branding — a major development in a FOX10 News investigation into two local companies that customers say took hundreds of thousands of dollars and delivered nothing.
In a statement to FOX10 News, Window Depot USA corporate said the Mobile operation was owned and operated locally by All Weather Roofing & Construction, an independently owned business that had been authorized to use the Window Depot trademark. The statement reads, in part:
“With respect to your question regarding the Mobile operation’s affiliation with Window Depot USA, that business is no longer authorized to use the Window Depot name, trademarks, branding, or related intellectual property in connection with the conduct of business.”
The corporate office also said it is gathering information to understand the current status of the business and the circumstances surrounding recent events, adding that its concern is for homeowners who may be affected.
FOX10 News has been investigating All Weather Roofing and Construction LLC and Window Depot USA of Mobile since late May. More than 54 customers say they paid the companies thousands of dollars for roofing and window services — and received nothing in return. Mobile police are actively investigating more than 50 cases. Customers report combined losses of nearly $500,000.
At least eight lawsuits have been filed against the two companies. Court documents show two other local businesses claim the owners owe them more than $400,000 combined — on top of the consumer losses already under investigation.
The companies are linked to Ward Fendley and his wife Theresa Fendley, according to the Better Business Bureau and Secretary of State filings. Theresa Fendley is listed as the designated qualifying representative for All Weather Roofing and Construction LLC on the Alabama Home Builder Licensure Board’s website. The company’s license remains active through the end of 2026.
Window Depot USA corporate has removed Mobile from its list of locations on its website.
The Better Business Bureau revoked All Weather Roofing and Construction LLC’s accreditation after the company failed to address numerous complaints.
The Alabama Home Builder Licensure Board says it is aware of the reports. Customers are filing consumer complaints with the board. Once notified, a licensee has 20 days to respond before a formal investigation opens.
The Alabama Attorney General’s Office has not confirmed or denied an investigation.

“We are aware of the reports involving the Mobile, Alabama operation, which was owned and operated locally by All Weather Roofing & Construction, an independently owned business that had been authorized to use the Window Depot trademark.
At this time, we are in the process of gathering information to better understand the current status of the business and the circumstances surrounding recent events. Because facts are still being developed, I believe it would be inappropriate to speculate or comment on matters that have not yet been independently verified.
With respect to your question regarding the Mobile operation’s affiliation with Window Depot USA, that business is no longer authorized to use the Window Depot name, trademarks, branding, or related intellectual property in connection with the conduct of business.
Our concern is for the homeowners who may be affected, as well as for everyone involved personally and professionally. As we gain a clearer understanding of the facts, we will evaluate whether additional comment is appropriate.”
No criminal charges have been filed against the Fendleys. Ward and Theresa Fendley have not responded to FOX10 News’ repeated requests for comment.
